These Terms & Conditions govern the use of the MindCare website and participation in MindCare services. By accessing this website or booking a session, you agree to be bound by these terms.

MindCare, we, and our refer to the online hypnotherapy practice based in Abu Dhabi, United Arab Emirates, operated by Etienne Schubach and Nadine Schubach. You refers to any website user, visitor, or client.

1. Nature of Services and Scope of Practice

MindCare provides non-medical, complementary hypnotherapy services and, where indicated, coaching services. Our work is intended to support personal development and wellbeing.

We do not diagnose, treat, or cure medical or psychiatric conditions.

We do not prescribe medication.

We do not provide crisis intervention or emergency mental health services.

Hypnotherapy and coaching at MindCare are intended to sit alongside appropriate medical or psychological care, not to replace it. If you have any concerns about your physical or mental health, you should consult a licensed medical doctor, psychologist, psychiatrist, or relevant health professional.

2. Eligibility

MindCare currently works with clients who are legally able to consent to hypnotherapy in their country of residence.

By booking a session, you confirm that you are at least 18 years old, or the age of majority in your jurisdiction if higher, and that you are legally able to enter into this agreement.

MindCare does not currently offer hypnotherapy for children or adolescents.

3. Online-Only Service and Geographic Scope

MindCare is based in Abu Dhabi, United Arab Emirates. All sessions are delivered online only via secure video platforms such as Zoom or Google Meet.

Services are intended for clients residing in the UAE and in other countries where it is legally permitted for you to receive such services from abroad.

You are responsible for ensuring that booking and attending online hypnotherapy sessions complies with the laws and regulations of your own country or region.

4. Client Responsibilities

You agree to provide complete and accurate information during booking, consultation, and intake processes and to inform us of any relevant medical, psychological, or psychiatric history, including diagnoses, medications, and treatments.

You agree to continue seeking appropriate medical and psychological care where needed and to inform us of any changes that may affect your participation in sessions.

You agree to attend sessions on time, from a private and safe environment, and to engage honestly and respectfully in the process.

5. Emergency and Crisis Situations

MindCare does not provide emergency or crisis services.

If you are in immediate danger, at risk of harming yourself or others, or experiencing a medical or psychiatric emergency, you must contact local emergency services or an appropriately qualified healthcare professional immediately.

Do not rely on email, messaging, or online booking with MindCare in any emergency or crisis situation.

6. Online Sessions and Technical Requirements

All sessions are conducted online.

You are responsible for having a stable internet connection, a suitable device with camera and audio capabilities, and a quiet, private space where you will not be overheard or interrupted.

If a session is disrupted by technical issues on your side, we will make reasonable efforts to reconnect. If a substantial portion of the session is lost, any decision regarding rescheduling will be made at our discretion.

If technical issues occur on our side, we will reschedule the session at no additional cost.

 7. Bookings, Cancellations, and Rescheduling

7.1 Booking and Payment

Payment terms will be provided at the time of booking.

A session is considered confirmed once booking and any required payment have been completed.

7.2 Cancellation and Rescheduling Policy

To maintain a fair schedule for all clients, we ask for at least 24 hours’ notice to cancel or reschedule a session.

If more than 24 hours’ notice is given, you may cancel, reschedule, or request a refund without charge.

If less than 24 hours’ notice is given, or if you do not attend your appointment, the session may be charged in full.

Repeated late cancellations or missed sessions may result in future bookings being declined.

If MindCare needs to cancel or reschedule a session, we will offer an alternative appointment or provide a refund.

7.3 Refunds

If a cancellation is made more than 24 hours before the scheduled appointment, a full refund may be requested.

Cancellations made less than 24 hours before the scheduled appointment, missed appointments, and late arrivals are generally non-refundable.

If MindCare cancels a session and an alternative appointment cannot be agreed upon, a full refund will be provided.

Refund requests relating to exceptional circumstances may be considered at MindCare’s discretion.

8. Nature of Hypnotherapy and Coaching

8.1 Hypnotherapy

Hypnotherapy at MindCare involves working with a state of focused attention, often accompanied by physical relaxation. In this state, the mind may be more receptive to beneficial suggestions and alternative perspectives.

You remain aware, able to communicate, and in control throughout.

You cannot be forced to act against your will or values.

MindCare does not offer stage hypnosis or any form of entertainment-oriented hypnosis.

Outcomes vary between individuals, and no specific results can be guaranteed.

8.2 Coaching

Where coaching is provided, it is offered by an ICF-accredited coach within the practice. Coaching is focused on goals, clarity, and practical steps, and does not constitute psychotherapy, counselling, or medical advice.

Coaching may be integrated with hypnotherapy where appropriate and clearly agreed, but always within the scope and limits set out in these Terms.

9. No Guarantees

While MindCare aims to provide a thoughtful, well-structured environment for personal work, no specific outcomes or results are guaranteed.

Your progress depends on multiple factors, including your engagement and participation, your circumstances and history, the complexity of the issues you bring, and the involvement of appropriate medical or psychological care where needed.

Testimonials and examples on the website illustrate individual experiences and do not represent a promise of similar results.

10. Privacy and Confidentiality

MindCare respects your privacy and confidentiality.

Information shared in sessions is treated as confidential, within the limits of the law and our professional duty of care. This may include situations where there is a serious risk of harm to you or others, or where disclosure is required by law.

11. Intellectual Property

All content on the MindCare website, including text, images, logos, design, downloadable materials, and any recordings or written materials provided to you, is owned by MindCare or used with permission.

MindCare is not responsible for decisions you make or actions you take as a result of information received through this website or during sessions.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
